MiCA's register of non-compliant CASPs

Register of non-compliant entities providing crypto-asset services is a measure introduced by MiCA, which will allow ESMA to collect and publish information on CASPs that provide services without the proper authorisation in the EU đȘđș or that exploit the clientâs own initiative exemption foreseen by MiCA.
This register will be non-exhaustive and shall contain at least the commercial name or the website of a non-compliant entity and the name of the competent authority that submitted the information. The register shall be publicly available on ESMAâs website in a machine-readable format which will allow the integration with existing screening and business information solutions used by, among others, financial institutions.
In consequence, the register might soon become a kind of black list of crypto entities in the EU, possibly preventing such entities from cooperating with entities from the EU, including in particular, financial institutions.
The register will be updated by ESMA on the basis of infringements of MiCA identified by ESMA on its own initiative as well as on the basis of information submitted by the relevant supervisory authorities of third countries. In the latter case, ESMA may apply the relevant supervisory and investigative powers of competent authorities to such non-compliant entities providing crypto-asset services.
